Introduction
These Terms of Service ("Terms") govern your use of the Banikh platform. By creating an account or using our services, you agree to these Terms.
Service Description
Banikh is a hosted ecommerce platform that allows merchants to create online stores, list products, accept payments (bKash, Nagad, COD), and manage deliveries through integrated couriers (Steadfast, Pathao, RedX). We provide the technology; you run your business.
Account Responsibilities
You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration. You are responsible for all activity under your account. You must be at least 18 years old to use our services.
Acceptable Use
You agree to use Banikh only for lawful ecommerce activities. You may not sell prohibited goods (illegal items, counterfeit products, regulated substances without proper licensing). We reserve the right to suspend or terminate stores that violate these terms or applicable Bangladeshi law.
Pricing & Payments
Our plans are priced in BDT (Bangladeshi Taka). Prices are subject to change with 30 days notice. We do not charge transaction fees on your sales — you only pay your monthly subscription and any fees charged directly by payment gateways (bKash, Nagad) or couriers.
Content & Data Ownership
You retain full ownership of your store content, product data, customer data, and order history. We do not claim any rights over your data. You grant us a limited license to host and display your content as needed to operate the platform. You may export your data at any time.
Service Availability
We strive to keep the platform available at all times but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our control.
Termination
You may cancel your account at any time from your dashboard. We may suspend or terminate accounts that violate these Terms. Upon termination, you will have 30 days to export your data before it is permanently deleted.
Limitation of Liability
Banikh is provided "as is". We are not liable for any indirect, incidental, or consequential damages arising from use of the platform. Our total liability is limited to the amount you paid us in the 12 months preceding any claim.
Governing Law
These Terms are governed by the laws of the People's Republic of Bangladesh. Any disputes shall be resolved in the courts of Dhaka, Bangladesh.
