Introduction

These Terms of Service ("Terms") govern your use of the Banikh platform. By creating an account or using our services, you agree to these Terms.

Service Description

Banikh is a hosted ecommerce platform that allows merchants to create online stores, list products, accept payments (cash on delivery, plus one-click checkout through integrated gateways and aggregators including SSLCommerz, SurjoPay, AamarPay, and direct bKash/Nagad APIs as they ship during public beta), and manage deliveries through integrated couriers (Steadfast, Pathao, RedX). We provide the technology; you run your business.

Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration. You are responsible for all activity under your account. You must be at least 18 years old to use our services. You confirm that your business does not sell goods or services that violate Islamic principles (Banikh is a halal-only platform).

Acceptable Use

Banikh is for lawful ecommerce activities only. We reserve the right to suspend or terminate any account that violates this section, applicable Bangladeshi law, or basic standards of honest commerce.

Prohibited Goods & Services

You may not list, sell, or facilitate the sale of any of the following on a Banikh storefront:

• Alcohol, tobacco, and intoxicants of any kind.
• Pork, pork-derived products, or any non-halal meat or food product.
• Gambling, lottery, betting, raffles, or any games of chance involving money.
• Adult content, dating services, escort services, or sexually suggestive products.
• Weapons, ammunition, or explosives without proper Bangladesh government licensing.
• Illegal drugs, controlled substances, or drug paraphernalia.
• Counterfeit, replica, or unauthorized brand-name goods.
• Prescription medicines without a valid pharmacist license.
• Multi-level marketing (MLM), pyramid schemes, or any scheme where income depends on recruitment.
• Financial services, lending, investment products, or cryptocurrency exchanges without a Bangladesh Bank or BSEC license.
• Anything banned under the Bangladesh Penal Code, the Digital Security Act, or any other applicable Bangladeshi law.

Anti-Spam

You may not send bulk unsolicited marketing messages. Every marketing SMS sent through Banikh must include a STOP keyword for opt-out (mandatory under BTRC rules — enforced by the platform). Marketing email must include a working unsubscribe link. High spam-complaint or bounce rates will trigger a marketing freeze on your account per our anti-abuse policy.

Intellectual Property

You may not list products using photos, logos, descriptions, or other content that you do not own or have explicit permission to use. Repeat-infringer accounts will be terminated. Rights holders may request removal of infringing content by emailing [email protected] with proof of ownership.

Honest Commerce

You may not post deceptive listings, fake reviews, manipulated pricing (bait-and-switch), false delivery promises, or any other content designed to mislead customers. Misrepresenting your business identity or location is grounds for immediate suspension.

Enforcement

First-time violations of this Acceptable Use policy typically result in a written warning and a request to remediate. Repeat or severe violations (illegal goods, fraud, harm to customers) result in immediate suspension and may be reported to Bangladesh authorities. We reserve the right to terminate accounts and remove content at our sole discretion to protect the safety and reputation of the platform and other merchants.

Pricing & Payments

Our plans are priced in BDT (Bangladeshi Taka). Prices are subject to change with 30 days notice. We do not charge transaction fees on your sales — you only pay your monthly subscription and any fees charged directly by your chosen payment gateways or aggregators (e.g. bKash, Nagad, SSLCommerz, SurjoPay, AamarPay) or couriers. Content & Data Ownership

You retain full ownership of your store content, product data, customer data, and order history. We do not claim any rights over your data. You grant us a limited license to host and display your content as needed to operate the platform. You may export your data at any time.

Service Availability

We strive to keep the platform available at all times but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our control.

Termination

You may cancel your account at any time from your dashboard. We may suspend or terminate accounts that violate these Terms. Upon termination, you will have 30 days to export your data before it is permanently deleted.

Limitation of Liability

Banikh is a platform provider and is not a party to transactions between merchants and their customers. We are not liable for product quality, delivery, refunds, or any dispute between a merchant and their customer. The platform is provided "as is". We are not liable for any indirect, incidental, or consequential damages arising from use of the platform. Our total liability is limited to the amount you paid us in the 12 months preceding any claim.

Governing Law

These Terms are governed by the laws of the People's Republic of Bangladesh. Any disputes shall be resolved in the courts of Dhaka, Bangladesh.
